1. Scope

These Terms of Service apply to all purchases made via our online shop BergSitz by customers with delivery addresses in Switzerland.
By placing an order, you agree to these terms as valid at the time of purchase.

2. Offer and Contract Formation

The product display on our website does not represent a legally binding offer but an invitation to order.
By clicking “Buy Now”, you make a binding purchase offer.
The contract is concluded when you receive an order confirmation by email.

3. Prices and Payment

All prices are shown in CHF (Swiss Francs).
Payment can be made via credit card, PayPal, or other secure payment options shown at checkout.
Transactions are processed through encrypted connections.

4. Shipping and Delivery

We deliver only to Switzerland.
All orders are shipped from our warehouse in Germany.
Shipping is free of charge.
Estimated delivery time: 4–12 business days
Once dispatched, you will receive an email with a tracking link.

5. Retention of Title

The goods remain the property of BergSitz until full payment has been received.

6. Returns and Refunds

You may return items within 30 days of delivery if they are unused, unwashed, and in their original packaging.
Return shipping costs are the customer’s responsibility unless the product is defective or damaged.

Cancellation fees

In the event of cancellation, we reserve the right to charge 30% of the total amount as a processing and expense allowance. The fee is payable regardless of the reason for cancellation and will be invoiced immediately upon receipt of the cancellation request.

7. Warranty and Liability

Statutory warranty rights apply.
We are not liable for damages caused by misuse or improper handling of our products.

8. Data Protection

Your personal data is processed exclusively for order handling in accordance with our Privacy Policy.

9. Applicable Law and Jurisdiction

This agreement is governed by German law, excluding the UN Sales Convention.
For consumers residing in Switzerland, mandatory Swiss consumer-protection laws remain unaffected.
